1. Acceptance of Terms

By installing, accessing, or using the LumiList browser extension and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

LumiList is a bookmark manager extension operated by Lumiscale Branding (OPC) Pvt. Ltd. that allows users to save, organize, sync, and manage their bookmarks in a new tab interface.

3. User Accounts

To access cloud sync, you must create an account by signing in with Google. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. User Data

Data Collection: When you use LumiList, we collect and store the following data:

• Bookmark information (titles, URLs, descriptions)
• Organizational data (pages, boards, and their configurations)
• Account information (email address for registered users)

Data Storage: Your data is stored locally in your browser using IndexedDB. If you create an account and enable sync, your data is also stored securely on our servers powered by Supabase, with industry-standard encryption.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service to store, distribute, or link to any content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
• Use automated means to access the Service for any purpose without our express written permission
• Reverse engineer, decompile, or disassemble any portion of the Service

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

6. Subscriptions and Payments

Workspace Access: LumiList offers subscription-based access to paid workspace features after any applicable trial period.

Free Trial: Unless LumiList expressly grants an exception, the free trial is available once per sign-in identity. Deleting an account, creating it again, or otherwise recreating the same sign-in identity does not reset trial eligibility. Attempting to repeatedly obtain the trial may result in the trial option being unavailable.

Plans: LumiList may offer monthly and yearly subscription plans. Current plan pricing is shown before checkout and may vary by region, taxes, currency, and promotional availability.

Billing: Payments may be processed through Razorpay or another supported payment gateway. By starting a paid subscription, you authorize recurring billing for the selected plan until the subscription is cancelled.

Subscription Terms:

• Subscriptions automatically renew at the end of each billing period unless cancelled
• You may cancel your subscription at any time through the account management page
• Cancellation takes effect at the end of the current billing period

Refund and Cancellation

• You may cancel your subscription at any time. The cancellation will be effective from the end of the current billing cycle.
• If you are not satisfied with the Service, you can request a full refund within 7 days of your purchase.
• To request a refund, email us at lumilistapp@gmail.com.
• Refunds are processed within 5-7 business days and will be credited back to your original payment method.

Shipping & Delivery Policy

LumiList is a digital product (browser extension). No physical products are shipped.

7. Intellectual Property

Our Property: The LumiList extension, including its design, code, graphics, logos, and all related intellectual property, is owned by LumiList and is protected by applicable copyright, trademark, and other intellectual property laws.

Your Content: You retain all rights to the content you create within LumiList, including your bookmarks, pages, and boards. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

Feedback: If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to compensate you.

8. Limitation of Liability

Disclaimer of Warranties: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability: To the maximum extent permitted by applicable law, LumiList and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or content
• Loss of profits or revenue
• Service interruptions or downtime
• Any damages resulting from unauthorized access to your account

Our total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts located in Nashik, Maharashtra, India.
